Boat Fuel Finder — Terms of Service

These Terms of Service ("Terms") govern your access to and use of Boat Fuel Finder, the website and services at boatfuelprice.com and related domains (the "Service"), operated by SeaSure INC ("SeaSure," "we," "us," or "our").

Please read these Terms carefully. They include important disclaimers about the accuracy of fuel prices and predictions (Sections 3 and 4), a limitation of our liability (Section 12), and a binding arbitration provision and class-action waiver (Section 16) that affect how disputes are resolved.

1. Acceptance & Eligibility

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into a binding agreement.

2. What Boat Fuel Finder Is

Boat Fuel Finder is an informational tool that aggregates and displays marina and fuel-dock pricing from multiple sources — automated data collection, third-party APIs, agent phone outreach, and user-submitted reports — and provides related analytics and signals, including regional dashboards and the "Market Pulse" Buy/Wait indicators. The Service is provided for general informational purposes only.

The Service is a separate product from the SeaSure marine maintenance platform and does not provide marine maintenance, repair, navigation, or safety services.

3. Fuel Prices Are Informational and Not Guaranteed

We do our best to display current and accurate fuel prices, but we do not and cannot guarantee that any price shown on the Service is accurate, complete, current, or available. Fuel prices are set by the individual marinas and fuel docks, and a station may change its prices, fuel availability, hours, or services at any time, without notice to us. Prices on the Service may be outdated, estimated, mistaken, or sourced from reports we have not independently verified.

You should always confirm the actual price, availability, and hours directly with the fuel dock before relying on it. You use price information at your own risk, and SeaSure is not responsible for any difference between a price shown on the Service and the price actually charged.

4. Market Pulse, Predictions & "Buy/Wait" Signals Are Not Advice

The Market Pulse signals, Market Momentum Score, station-level predictions, trend analytics, and any "Buy Now," "Wait," or similar recommendations are informational and experimental. They are based on models that are under development and may be inaccurate. They are not financial, investment, trading, or commercial advice, and they are not a guarantee of future prices. Any decision you make about when or where to buy fuel is your own. SeaSure is not liable for decisions made in reliance on these signals.

5. Accounts

If the Service offers accounts, you are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. User Submissions

The Service lets you submit fuel-price reports and other content ("Submissions"). When you make a Submission:

  • You represent that it is accurate to the best of your knowledge, that you have the right to submit it, and that it does not violate any law or any third party's rights;
  • You grant SeaSure a worldwide, perpetual, irrevocable, royalty-free license to use, store, reproduce, modify, publish, display, and distribute the Submission and the data in it — including as part of our pricing dataset, analytics, and historical records — in connection with operating and promoting the Service;
  • You understand that we may publish your Submission (without your name unless you choose to share it), combine it with other data, and retain it as part of the historical dataset; and
  • We are not obligated to use any Submission, and we may remove or edit Submissions at our discretion.

You must not submit false, misleading, manipulated, automated, or spam price reports.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Scrape, crawl, harvest, or use automated means to extract data from the Service, or copy or resell our data, except as we expressly permit in writing;
  • Interfere with, overload, or disrupt the Service or its infrastructure;
  • Attempt to gain unauthorized access to any part of the Service or its systems;
  • Reverse engineer or attempt to derive source code, except where the law prohibits this restriction;
  • Submit false or manipulated data; or
  • Misrepresent your affiliation with any person or entity.

8. Intellectual Property

The Service — including its software, design, text, graphics, compilations of data, analytics, and the Market Pulse methodology — is owned by SeaSure INC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved. "Boat Fuel Finder," "SeaSure," and related logos are our trademarks.

9. Third-Party Data, Marinas & Links

The Service includes data and content from third parties (including data providers, marina directories, and market-data sources) and may link to third-party sites. We do not endorse, and are not responsible for, third parties, their data, their pricing, their products, or their services. References to marinas, fuel docks, brands, or data sources do not imply any affiliation with or endorsement by them, and all third-party names and marks belong to their respective owners.

10. Email Communications

By providing your email and using the Service, you agree that we may send you emails as described in our Privacy Policy, including service messages. For users in the United States, this also includes marketing messages unless you opt out; for users outside the United States, we send marketing messages only where we have obtained your consent as required by local law. The sharing of your email with third parties for their own marketing applies to U.S. users only and is described in our Privacy Policy. You may unsubscribe from marketing emails at any time using the link in those emails or by contacting us at info@seasure.ai.

11. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL FUEL PRICES, DATA, PREDICTIONS, AND SIGNALS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, SeaSure disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties of accuracy, reliability, availability, or that the Service will be uninterrupted or error-free. We do not warrant that any price, prediction, or other information on the Service is accurate or current.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SeaSure INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST SAVINGS, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON FUEL PRICES, PREDICTIONS, OR OTHER INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL SeaSure's TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless SeaSure INC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Submissions, or your violation of these Terms or any law or third-party right.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 3, 4, 6, 8, 11, 12, 13, and 16) will survive.

15. Changes to the Terms and the Service

We may modify these Terms at any time by posting the updated version and revising the "Last Updated" date. For material changes, we will provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms. We may also change, suspend, or discontinue any part of the Service at any time.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Binding Arbitration; Class-Action Waiver. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and SeaSure each waive any right to a jury trial and any right to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by sending written notice to info@seasure.ai within 30 days of first accepting these Terms.

Court venue (carve-outs and fallback). If you opt out of arbitration, if a dispute is not subject to arbitration, or if the arbitration agreement is found unenforceable, that dispute will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and SeaSure regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. The Service is controlled and operated from the United States.
